Officer’s gun was used in shooting
Sheriff: Pistol was taken from deputy’s holster

The pistol used by a Porum man to shoot at lawmen Saturday night had been taken from one of the officers, investigators said Tuesday.

Deputy Joe Johnson, Deputy David Mackey and Warner Police Officer Adam Satterfield had responded to a domestic disturbance call at the home of Kevin Dwayne Girty, said Muskogee County Sheriff Charles Pearson. The officers had convinced Girty to give up several knives, Pearson said.

The four were in a small bedroom of the home when a scuffle broke out. During the melee, Girty managed to grab a loaded, .40-caliber pistol from Johnson’s holster, Pearson said.

Girty allegedly shot Mackey in his hand, and the bullet went into his stomach. Girty also allegedly shot at Satterfield. Both officers were treated at area hospitals and released.

Girty was charged Tuesday in Muskogee County District Court with two counts of assault and battery with a deadly weapon. He is being held without bond and also was charged with possession of a firearm after former conviction of a felony.

Lawmen first answered a domestic disturbance call about 6 p.m. Saturday at the Girty residence near Porum. Pearson said Girty’s wife did not have any marks on her and did not want to file charges when officers arrived.

Unless marks had been noted, no arrest could be made, Pearson said.

Girty was coaxed into leaving with lawmen, who took him to a relative’s home.

About 8:10 p.m., a call came in that Girty had come back into his house and threatened to kill himself with a knife. Officers found two knives strapped to Girty’s hands and a knife in his pocket, Pearson said.

Girty was talked into unstrapping a 9-inch butcher knife and a large, serrated knife. Another medium-sized serrated knife was found in his pocket, officials said.

As the bedroom scuffle broke out, Satterfield attempted to use a Taser to subdue Girty. He was so close the Taser wasn’t very effective, said Warner Police Chief Terry Thompson.

Girty has a felony record dating from the 1980s and 1995, according to court records.

Muskogee County District Attorney Larry Moore filed a supplement with the court Tuesday stating that Girty was convicted in December 1995 of two felonies and received two, 10-year prison sentences.
