Time records of an investigator who worked for former District Attorney Richard Loy Gray Jr. will be allowed into evidence at Gray’s June 2 criminal trial.
Gray is the former top prosecutor for Adair, Cherokee, Wagoner and Sequoyah counties. He is accused of embezzling more than $9,000 from his district’s drug task force funds, which he denies.
Okmulgee County District Judge H. Michael Claver made the ruling Thursday.
The state had sought to keep Gray from bringing various financial and personnel records of former investigator Clint Johnson into play in the criminal case.
The judge ruled for the state in its request the affidavit of Shaunna Clark, a clerk in Gray’s office, be excluded from the trial.
Testimony of several other defense witnesses may become relevant at trial, the judge ruled, saying the issue will be addressed at that time.
