A Westville man suspected in a Wednesday drive-by shooting was shot in the leg by a deputy returning fire, making two officer-related shootings in two days in Adair County.
Lewis Cypress, 24, underwent surgery late Wednesday and was listed in good condition. His vital signs were stable, a spokeswoman from Washington Memorial Hospital in Fayetteville, Ark., said Thursday afternoon.
On Tuesday, Marty Workman, 30, was shot and killed by a Cherokee Nation Marshal as he walked toward lawmen pointing a gun at them, according to Oklahoma Bureau of Investigation Public Information Officer Jessica Brown.
Cypress abandoned his car Wednesday after allegedly shooting at a car. Several hours later, a deputy alerted to Cypress’ whereabouts found him staggering northbound down the middle of the southbound lane of Oklahoma 51E near the Fairfield community near Stilwell, said Adair County Sheriff Gerald Coleman.
No one was injured in the alleged drive-by, Coleman said.
Adair County Sheriff’s Deputy Frank Cheesman and other people who saw Cypress on the road said he appeared to be very intoxicated, Coleman said.
Cheesman stopped his vehicle a distance from Cypress, who started stumbling in his direction, Coleman said. Cheesman told him to wait, that he would get out of his vehicle and come to him.
“As Cheesman’s left foot hit the ground, Cypress fired his first shot,” Coleman said. “The bullet hit the pavement and glanced off the driver’s side door. Then Cypress shoots two rounds into the door.
“That’s when the deputy took a leg out from under the suspect.
“It shattered his leg below the knee and he crumpled to the ground. The deputy didn’t have to kill him — but he was hurt bad.”
The shooting occurred about 9:41 p.m., Coleman said.
Coleman said he was told late Wednesday that physicians thought they would have to amputate the lower part of Cypress’ leg. But a follow-up call from the hospital said amputation was not required.
Court records in Cherokee County District Court show Cypress pleaded not guilty on June 10 to false impersonation, a crime he was charged with in 2004. He is scheduled to appear in court on Monday for a sounding docket on that felony.
