Moore declines charges against driver

DA won’t pursue stolen-property complaint against Muskogee man

— A Muskogee man will not face charges stemming from a traffic stop that preceded an officer-involved shooting.

Marvin Green, 22, was booked into the Muskogee County/City Detention Facility on Thursday on complaints of receiving stolen property.

Muskogee police stopped the vehicle Green was driving because it matched the description of a car reported stolen earlier in the day, authorities said.

“We have to show knowledge of the driver that it was stolen,” Muskogee County District Attorney Larry Moore said. “In this particular case, we’ve declined prosecution on it.”

Green remained in jail Monday afternoon, jail personnel said. He was being held without bond for failure to appear on a possession of controlled dangerous substance charge, which was filed in 2010. Court records show that a bench warrant — failure to appear was filed against Green on Oct. 30. Sentencing is scheduled on this case for Jan. 21, court records state.

Green was the driver of a car that was stopped by Muskogee police near South Fourth and Elgin, a media release states. Thomas Estes, 33, and another individual were passengers in the car.

Estes was shot after he allegedly attempted to disarm one of the two officers at the scene, the release states.

Estes was taken to EASTAR Health System and then transported to a Tulsa hospital. His condition was not available Monday.

The Oklahoma State Bureau of Investigation is conducting an investigation of the shooting.

Officers Joe Poffel and Wesley Biles have been placed on routine administrative leave, the release states.

A female passenger in the vehicle was questioned and released.
