Hearing to open in fatal accident


— A preliminary hearing for a man accused of killing a 12-year-old will be held today in Wagoner County District Court, court records state.

Richard Ray Roth, 34, of Wagoner, was arrested for allegedly driving while intoxicated, and hitting and killing Billy Jack Chuculate Lord on Nov. 8.

Roth is charged with first-degree manslaughter, leaving the scene of a fatality accident, and a misdemeanor charge of driving under the influence.

Testimony will be presented during the 9 a.m. hearing. Following the hearing, a judge will decide if Roth should stand trial.

According to court documents, police were called to Ninth and Story streets in Wagoner about 10:30 p.m. Nov. 8.

Wagoner police Officer Don Chamber stated in the document that Roth admitted he had been drinking and that he had consumed two beers.

After he hit Lord, Roth checked on Lord and then went home. Roth returned with his wife, who was a paramedic, court documents state.
