Area man in court on manslaughter

Suspect accused in death of 12-year-old

— WAGONER — A Wagoner man who is accused of killing a 12-year-old appeared in court Tuesday.

Richard Ray Roth, 34, has been charged with first-degree manslaughter, leaving the scene of a fatality accident and a misdemeanor charge of driving under the influence, court records state.

Charges were filed in Wagoner County District Court against Roth on Friday. He is being held on $500,000 bond.

During an initial appearance Tuesday, Roth told Judge Dennis Shook that he could not afford an attorney.

Shook said he would request that the Oklahoma Indigent Defense System represent Roth.

About a dozen members of Roth’s family —  including his mother and his wife — attended the brief court proceeding Tuesday and sat in the first two rows.  Brenda Roth said they attended to show their support to her son.

Roth was arrested for allegedly driving while intoxicated and hitting and killing Billy Jack Chuculate Lord on Nov. 8  following a collision at Ninth and Story streets in Wagoner. On Nov. 12, Roth’s bond was set at $500,000 bond.  

According to court documents, police were called at approximately 10:25 p.m. Nov. 8.  Wagoner Police Officer Don Chamber stated in the document that Roth admitted he had been drinking and that he had consumed two beers.

After he hit Lord, Roth checked on him then went home to get his wife, who was a paramedic, and they returned to the scene, court documents state.

Roth’s case will be included in the Dec. 5  preliminary hearing conference docket. At that time a date will be set for a preliminary hearing.
