Warner man gets suspended sentences in rape case

A Warner man charged with rape and molestation of a 9-year-old girl received three concurrent 20-year suspended sentences in the case.

Charles James “Chuck” LaBounty, 48, had been charged in Muskogee County District Court with five counts of lewd molestation and three counts of rape by instrumentation. He was arrested and charged in September. He pleaded guilty Thursday to two counts of lewd molestation and one count of rape. The other charges were dismissed.

Because the victim did not want to go to court to testify, the Muskogee County District Attorney’s Office agreed to the suspended sentences.

“You have to remember the most important person in a case like this is the victim, not the defendant,” said Larry Moore, district attorney. “You must consider the victim’s emotional and mental state of mind and what further damage will be caused to the victim by forcing her to appear in court.”

Although LaBounty received probation, he will not just walk free. He will be supervised under the sex offender rules and conditions of probation, which includes monthly reporting and registering for life as a sex offender, Moore said.

LaBounty’s estranged wife, Sherry LaBounty, 48, is charged with enabling abuse. Her case is set for a disposition docket Friday.
