Hugo defends federal lawsuit over water sale

Today, after following all known state law, Hugo has lost millions of dollars in potential water revenue while the Oklahoma Legislature conjures up plans to delay having to address present water law issues. Costs to Oklahoma taxpayers or ratepayers to the Corps of Engineers for Sardis Lake have likewise increased 10-fold.

Those facts have led us to the present legal challenge by Hugo to Oklahoma's ill-advised and unconstitutional moratorium on out-of-state water sales. Oklahoma is not permitted to regulate interstate commerce in water in an arbitrary manner when that power has been reserved to the federal government by the Constitution.

Unfortunately, numerous state officials and those who aspire to become state officials — from Governor Brad Henry, to Attorney General Drew Edmondson, to Senate District 5 Candidate Jerry Ellis — have perceived some political advantage in taking positions contrary to the Constitution. In so doing, they have greatly impeded Hugo's efforts to improve the economic challenges presented by its present condition: having significantly more available water than the region can possibly need for any foreseeable time on the horizon. Effective political leadership would not only abide by constitutional commands, but also facilitate much needed revenues for Hugo's future.
