The preliminary hearing for a Fort Gibson police officer charged with lewd molestation was continued after the alleged victim, a 4-year-old girl, was unable to testify.
Kelly Scott Pierce, 39, is accused of inappropriately touching a 3-year-old girl who was enrolled in a day care center he owns.
Assistant District Attorney David Pierce said the child appeared to be intimidated by the courtroom setting.
“It was causing the child a lot of stress,” Pierce said. “They (the court) made a determination to continue the hearing before any testimony was offered.”
In order to present its case, prosecutors plan to make arrangements to videotape the child’s testimony.
